Terms and Conditions
1. The Promoter
The Promoter is Thurles Gaels GAA Club, Kickham Park, Mill Road, Thurles, Co Tipperary (hereafter referred to as the “Promoter”)
2. Lottery Licence
The Promoter was granted a lottery licence by Thurles District Court on 14th day of October 2023 pursuant to Section 28 of the Gaming and Lotteries Act, 1956 as amended by the Gaming and Lotteries (Amendment) Act 2019, Section 28. Pat Flanagan of Thurles Gaels GAA is the Licence Holder.
By entering this Raffle all entrants agree to be bound by these terms and conditions and any other conditions in the messaging or promotions of this Raffle. Any entries not complying with these terms and conditions will not be valid. The terms and conditions herein are governed by Irish Law and the parties submit to the exclusive jurisdiction of the Irish Courts.
3. Entry Requirements
3.1. Raffle Period
The Raffle will run from 30th of October 2023 to 26th December 2024 (Closing Date) inclusive. All competition entries must be received by the Promoter no later than midnight on the Closing Date. Any tickets received after this date will be disqualified. It is intended that the raffle draw will take place on the 27th December 2024.
3.2. To Enter
The Entrant must purchase either an online raffle ticket at the price of €25.00 per ticket from the Promoter at www.winaretrofit.ie or in the alternative a ticket directly from the Promoter or its authorised agent. On purchase of an online ticket or ticket for the raffle draw, all purchasers of tickets are automatically entered for the number of tickets corresponding to the purchasing amount.
3.3. Funding Restrictions
All income generated by the Raffle will be restricted to Thurles Gaels GAA programmes at Kickham Park, Mill Road Thurles, for the development of their current Club facilities.
3.4. Eligibility
The Raffle is open to all persons aged 18 years or over as at the date of the draw.
The Raffle is subject to all applicable, state, and local laws and regulations in the Republic of Ireland.
The Promoter reserves the right to reject any entry (and award the prize to an alternative winner) if it has grounds to believe the entrant has breached any of these terms and conditions- extending to what is set out in the Schedule hereto – acted fraudulently or illegally, or on other reasonable grounds and shall have no liability to an entrant for any loss or damage arising from such rejection.
4. The Prizes
4.1. The Retrofit Prize.
The retrofit prize will be awarded where the Promoter is satisfied that the lucky winner’s property is eligible with what is set out in the Schedule hereto. Where it is determined by the Promoter that the property in question identified by the lucky winner (and for the avoidance of doubt, the lucky winner is entitled only to identify one property for assessment purposes by the Promoter) does not fulfil the criteria as set out in the Schedule hereto then in the alternative:
4.2. The Cash Prize
The lucky winner shall receive €50,000 in lieu of the retrofit prize payable within thirty days of the Raffle.
4.4. Prize Limitations
The prizes are non-transferrable and only consist of what is listed above, subject to the criteria of what is set out in the Schedule. No alternative prize save what is set out in 4.2 above will be offered. The Promoter accepts no responsibility or liability to the lucky winner for any dissatisfaction with the prize or services provided in connection with the delivery of the prize set out in 4.1.
5. Winner Selection
5.1. Criteria for Inclusion in Draws
The Raffle consists of one individual draw for either one of the prizes set out in 4.1 or 4.2 above.
5.2. Winner Selections:
The lucky winner will be drawn by an independent person on 26th December 2024 Exact details of time and venue will be published and available on the website www.winaretrofit.ie and associated social media platforms in advance of the 27th December 2024.
5.4. Notification of Lucky Winners
The winner will be notified no later than 5 working days of the raffle either by post, email or telephone. The Promoter’s decision is final. The Promoter shall have no liability for the lucky winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for the lucky winner’s provision of incorrect or otherwise non-functioning contact information. If the winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time the winner notification is sent, the prize may be forfeited, and an alternate lucky winner selected.
The lucky winner will be required to provide proof of address and identity when collecting their prize.
5.5. Promotion of Lucky Winners
By entering this Raffle the lucky winner agrees to take part in reasonable post Raffle publicity by publishing winner’s names on the Thurles Gaels website, winaretrofit.ie website and all other social media platforms.
6. Use of Information
The Promoter respects and is committed to protecting your privacy. The personal information you provide will remain private and will only be used for the purposes of contacting the winners, unless otherwise requested by the individual. The lucky winners’ names will be announced on the website www.thurlesgaels.ie and www.winaretrofit.ie.
7. Limitation of Liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstance be responsible or liable to compensate the winner or accept any liability (under contract, or otherwise under law) for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees.

SCHEDULE
1. All houses built after 2011 are not eligible for fabric upgrades which include windows, doors, wall insulation, attic insulation, air tightness measures and ventilation systems, however all homeowners, including private landlords, whose homes were built and occupied before 2021 are eligible for heat pump installations and or Solar Photovoltaic panels/Solar Thermal panels. The age of your house is defined as the date your electricity meter was installed. All grant eligibility is in strict accordance with the terms and conditions of the SEAI Home Energy Grants Schemes. These eligibility works will be assessed when your energy assessment is carried out by SEAI Assessor.
2. All works will be carried out In strict accordance with SEAI Better Energy Homes terms and conditions and their Quality assurance requirements.
3. The Max Value of any one retrofit will be €100,000.00 Including Vat. All SEAI Eligible grants will be claimed by the Promoter and off set against the cost of the works of the project. The max size of any one house must not exceed 250m2.
4. A cash prize of €50,000 can be claimed by the lucky winner instead of the energy retrofit.
5. For homeowners that have high efficiency heating systems present and do not require an Air to water heat pump installation, a cost optimal approach will be carried out on this house in compliance with TGD L 2022 Conservation of Fuel and Energy Dwellings for the house to achieve the A3 standard. This will be assessed by the SEAI Technical assessor when carrying out the energy assessment report on the house.
6. Heat pump installations are eligible for first time systems. Homes that are seeking to replace a heat pump system where a heat pump was already present in the home are not eligible.
7. For those that do not own their home, for example a renting from a private individual landlord, Local Authority, social housing body etc, written consent must be received from the registered owners of the property prior to any works been carried out. A template form will be issued by the Promoter to be completed.
8. Tenants that are renting properties from a commercial private landlord/company that has multiple rental properties will have to complete an additional template form and show full compliance with the SEAI terms and conditions associated with the SEAI Better energy home scheme.
9. Energy retrofit upgrade works will not be carried out on a property if works of a similar nature have been carried out previously and SEAI grant for those measures have been claimed previously on the property. For example, if external insulation was carried out previous on a house and the associated grant claimed, then these works or any associated repair or remedial works to the external insulation will not be eligible.
10. The total amount of tickets available to be sold is 15,000. The date for the raffle is 27th December 2024. If the quota of tickets is not sold by this date, the competition organisers have the option to extend the deadline accordingly until the quota of tickets are sold. If the raffle does not take place on or before 30th April 2025, then the Promoter will cancel the raffle and will refund to all participants the ticket purchase price in full without deduction within 21 days of the date of notification of the raffle cancellation.
11. The entrant must state a valid Eircode of the building that they intend to retrofit, if the Eircode entry is left blank, it will be assumed that the entrant is entering the raffle for the cash prize of €50,000 only. The winner cannot add an Eircode once their ticket is chosen. They will be entitled to the €50,000 cash prize only.
12. Entrants from outside the 26 Counties are entitled to enter the draw. However, they must state an Eircode of the property that they intend to retrofit. The property must be located within the 26 counties of the republic of Ireland. The owner of the property for example Private homeowners, landlords, local authority must complete a consent form for works to be completed on their properties. These consent forms will be issued by the Promoter to the lucky winner for completion. If the entrant does not intend to get their home retrofitted or fails to complete the consent from the property owner, they will be entitled to the €50,000 cash prize.
13. Commercial properties / Non-Domestic properties are not included in the competitions. This competition is for domestic homes only
14. The Promoter can bring the date forward or extend the date as a result of unforeseen circumstances/ ticket sales etc. The Promotion of the raffle is wholly at the discretion of the Promoter.
15. All eligible grants available from SEAI will be claimed by the Promoter and offset against the project cost. The maximum cost of a home energy retrofit is €100,000 Including Vat @13.5% . all eligible SEAI Grants will be deducted from the overall project cost by the Promoter. The competition lucky winner/Homeowner must comply with all paperwork associated with any SEAI Grant claims.
16. Any structural defects associated with a property will not be covered under this raffle. The services of a Structural engineer, RIAI Registered Architect, Planning Consultants, Conservation architect, quantity surveyor, building services engineer etc does not come under the remit of this raffle. If the services of any third-party consultant that is outside the remit of the home energy retrofit is required, these services must be paid directly by the homeowner/lucky winner.
17. A property that is listed as a protected structure in any format cannot be included for retrofit works. A protected structure is a structure that a planning authority considers to be of special interest from an architectural, historical, archaeological, artistic, cultural, scientific, social or technical point of view. Such buildings are excluded from the raffle and deemed ineligible.
